Online Privacy Policy

1. Introduction

Kennedy Wilson Holdings, Inc. and its affiliates (“KW”, “Kennedy Wilson”, “we”, “us” or “our”) respect your privacy and are committed to handling personal information responsibly and in accordance with applicable law.  This privacy policy (the “Privacy Policy”) explains how we collect, use, disclose, and protect personal information when you visit or use:

  • Our websites, including www.kennedywilson.com and any other websites that link to this Privacy Policy (collectively referred to herein as the ”Website”);
  • Related online services, tools, and communications that link to or reference this Privacy Policy (together, the “Services”); and
  • If you apply for employment with us (this includes individuals applying for a role as an employee, consultant, contingent worker, contractor, intern or trainee, and regardless of whether the role is on a part-time, temporary or full-time basis, (collectively, an "Applicant"))

This Privacy Policy applies to personal information collected through the Services, as well as limited information we collect offline in connection with our online activities or job application process (for example, when you call us about information you viewed on our website and we enter details into our systems or if you apply for a position with us and do not use our Website or Services to submit your application).

This Privacy Policy is part of a layered approach to privacy. Depending on where you live and how you interact with us, additional notices may apply:

If there is any conflict between this Privacy Policy and a more specific notice we provide at the time of collection, the more specific notice will apply.

Our Services are hosted in the United States. If you access the Services, your information may be transferred to, stored in, or processed in the United States and other jurisdictions that may not provide the same level of data protection as your home country.

The Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not use the Services or provide any personal information.

2.  Information We Collect

The information we collect depends on how you interact with us and the Services.

2.1  Information You Provide Directly

You may choose to provide personal information to us when you:

  • Request information about our properties, investments, or services;
  • Submit a contact form, chatbot inquiry, or other online form;
  • Register for or attend events, webinars, or meetings;
  • Request investor relations information or email alerts;
  • Use self-service tools or portals that link to this Privacy Policy; or
  • Provide feedback or participate in surveys.

The types of personal information you may provide include:

  • Name, title, and organization;
  • Email address, telephone number(s), postal address, and country or region of residence;
  • Professional or business contact details;
  • Preferences and interests related to properties, markets, or investment strategies; and
  • Content of communications and any other information you choose to provide.

We may keep copies of your written communications with us (including emails, form submissions, chat transcripts, and similar correspondence).

2.2  Offline Collection and Business Relationships

We may also collect personal information offline in connection with our online activities, for example when you:

  • Meet with us at a property, conference, or event;
  • Communicate with us by phone or postal mail regarding information you viewed online; or
  • Engage with us as an investor, joint venture partner, lender, vendor, consultant, broker, or other business counterparty.

This may include contact details, information about your organization and role, contractual or transactional information, and other information relevant to our relationship.

2.3  Job Applicants

If you apply for employment with Kennedy Wilson via our careers pages or other recruitment channels that link to this Privacy Policy, we collect the information you provide (for example, in your application, résumé/CV, cover letter, or supporting documentation) and information from recruitment vendors and service providers that support the process.

Depending on the role and local law, this information may include:

  • Contact details and basic identifiers;
  • Employment history, education, qualifications, and professional licenses;
  • References and background-check information (where permitted by law);
  • Work authorization information and limited demographic information (such as veteran status or disability status, where permitted or required); and
  • Any other information you choose to provide as part of the recruitment process.

We use this information to evaluate candidates, manage recruitment, comply with legal obligations, detect fraud, and, if hired, support onboarding and employment.

2.4  Leasing-Related Information and Property Management

In some cases, we own, manage, or invest in properties where leasing and day-to-day property management are performed by third-party property management companies or affiliates. Those entities and their service providers (such as leasing platforms, concierge applications, package delivery services, and community apps) may collect personal information about prospective and current tenants and occupants, such as:

  • Names and contact details;
  • Dates of birth, government-issued identifiers, and Social Security or national ID numbers;
  • Current and prior addresses, employment and income information, and other financial details;
  • Vehicle information, emergency contacts, and related data; and
  • Lease application data, screening results, lease terms, and payment history.

In the ordinary course, property management companies and their service providers maintain and control the detailed leasing information and process it under their own privacy notices. Kennedy Wilson generally receives a more limited subset of this information needed to:

  • Oversee and manage its investments and operations;
  • Monitor property performance and occupancy;
  • Support financial reporting, analytics, and forecasting;
  • Address legal, regulatory, and compliance obligations; and
  • Evaluate, structure, or complete real estate transactions.

Where required by our agreements or law, we require property management companies and their service providers to implement appropriate data protection and security measures, obtain necessary consents, and limit their use and disclosure of personal information.

2.5  Usage Information and Cookies – information we collect automatically

When you visit our Website, we and our service providers may automatically collect certain information about your device and how you interact with the Services, including:

  • IP address and approximate location (e.g., city or country);
  • Device identifiers and device type;
  • Browser type, settings, and operating system;
  • Pages viewed, links clicked, search terms, and other activity on the Services;
  • Referring URLs and the site you visit next; and
  • Dates, times, and duration of visits, and interactions with our emails.

We use cookies, web beacons, pixels, and similar technologies (“Cookies”) to collect this information. Cookies are small text files stored on your device that help us:

  • Operate the Services and enable core features;
  • Understand how visitors use our websites;
  • Remember your preferences; and

2.6  Additional Sources

We may obtain information about you from other sources, including:

  • Publicly available sources and business registries;
  • Social media platforms where you interact with our content;
  • Affiliates within the Kennedy Wilson group;
  • Business partners, intermediaries, data providers, and marketing/analytics vendors; and
  • Governmental or regulatory authorities, credit reference agencies, or law enforcement, in compliance with applicable law.

We may combine information from these sources with information we collect directly.

3.  How We Use Information

Where permitted by applicable law, we use personal information for the following purposes:

  • Marketing and prospecting – Communicating with you about properties, investments, services, events, or news; sending investor updates; and maintaining and updating contact information.
  • Operating and improving our Website and Services – Operating, managing, administering, and improving our websites and online tools; customizing content; and analyzing usage.
  • Business operations and investor relations – Managing relationships with investors, tenants, property managers, lenders, vendors, and other counterparties; conducting due diligence; and managing contracts and transactions.
  • Leasing and property management oversight – Overseeing and evaluating leasing activities and property management carried out by third parties in connection with our investments.
  • Recruitment and employment – Processing job applications; managing recruitment; onboarding; and, where applicable, supporting employment.
  • IT operations – Operating and securing our IT systems; monitoring for fraud and misuse; and conducting security audits.
  • Security: physical security of our premises (including records of visits to our premises and CCTV recordings); electronic security (including login records and access details to our electronic systems, if applicable) and website security
  • Manage our use of tracking technologies such as cookies: including enabling you to manage your cookie preferences and analyse collected data to learn about our website, to improve our website, and to develop new products and services. This includes website analytics, identifying browsing trends and patterns and evaluating this information.
  • Legal, compliance, and risk management – Complying with legal and regulatory obligations; responding to legal process and government requests; performing audits; managing risk; and fraud prevention.
  • Legal proceedings: establishing, exercising, and defending our legal rights.

We may also use de-identified or aggregated information that does not identify you for research, analytics, and other purposes permitted by law.

4.  Cookies - Targeted Advertising, Analytics, and Google Services

6.  Closing Accounts and Email Preferences

If you maintain an online account with us and wish to close it, you may be able to do so directly through the relevant application or interface. If not, you may contact us at privacy@kennedywilson.com with “Account Closing” in the subject line and include the relevant account or application name and your username. We may request additional information to verify your identity before closing an account.

If you no longer wish to receive marketing emails from us, you can:

  • Click the “unsubscribe” link in our marketing emails; or
  • Email privacy@kennedywilson.com and request removal from marketing lists.

Even if you unsubscribe, we may still send you non-marketing communications (for example, about a transaction or your relationship with us).

7.  Disclosure of Information

We may disclose personal information to:

  • You, and, where appropriate and with your consent, members of your household, representatives, or others;
  • Affiliates within the Kennedy Wilson group, who provide data processing services necessary to provide you with our services (for example, to support the delivery of, provide functionality on, or help to enhance the security of our website), or who otherwise process personal data for purposes described in this Privacy Policy.   • Service providers and vendors that support our operations (for example, IT, hosting, analytics, advertising, marketing, communications, professional advisers, property management, and security);
  • Property management companies and related service providers responsible for leasing or operating properties in which we own an interest;
  • Business partners, joint venture partners, lenders, and other counterparties involved in transactions or ongoing business relationships;
  • Governmental, regulatory, or law enforcement authorities, courts, and external advisers where we believe disclosure is necessary or appropriate (for example, to comply with law or legal process, protect rights and property, or prevent fraud);
  • Third parties involved in corporate transactions, such as prospective or actual buyers, investors, or successors in the event of a merger, acquisition, reorganization, or sale of assets; and
  • Any other person with your consent to the disclosure (obtained separately from any contract between us)

8.  Security and Retention

We use administrative, technical, and physical safeguards designed to protect personal information under our control against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. These measures include access controls, system monitoring, and other security practices.

However, no method of transmission or storage is completely secure. We cannot guarantee absolute security of the Services or of your information.

We retain personal information for as long as needed to fulfill the purposes described in this Privacy Policy. For example:

  • For the duration of our relationship with you;
  • As needed to operate our business and the Services;
  • As required by legal, accounting, or reporting obligations; and
  • As needed to establish, exercise, or defend legal claims.

If you are an Applicant and you accept a role with Kennedy Wilson, where permitted by local law, the personal information we collect during the application process may be transferred to your personnel file. This will be stored in accordance with our Employee Privacy Policy, copies of which will be made available to you after you accept the role with Kennedy Wilson.

When personal information is no longer needed, we will delete or de-identify it, unless we are required or permitted by law to keep it longer.

Linking to Third-Party Websites

We may provide links to websites that are owned or operated by other companies (“third-party websites”) and our Privacy Policy does not apply to these third-party websites.  When you use a link online to visit a third-party website, you will be subject to that website’s privacy and security practices. You should familiarize yourself with the privacy policy, terms of use, and security practices of the linked third-party website before providing any information on that website.

9.  Additional Information for Certain U.S. State Residents

Residents of California and certain other U.S. states have additional privacy rights under state law. For more information, including:

  • Your rights to access, correct, delete, and obtain copies of your information; and

10.  Additional Information for EEA and UK Residents

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), EU and UK data protection laws provide additional rights and require us to disclose certain information, such as our legal bases for processing, international transfer safeguards, and your rights of access, rectification, erasure, restriction, objection, and portability.

11.  Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we do, we will revise the “Last updated” date at the top of this page and may provide additional notice where required (for example, by posting a banner or sending an email). Any changes will be effective when posted unless otherwise stated.
